ARCHITECTS / ENGINEERS 

Representing design firms in:

  • Collecting unpaid fees for architects and engineers with mechanics lien and contract claims, and through bankruptcy court proceedings.
  • Alleged violations of the Americans with Disabilities Act, Fair Housing Act, and their state and local equivalents.
  • Intellectual property matters, including copyright infringement claims brought by and against his designer clients.
  • Defending against error and omission and design malpractice claims with his clients’ professional liability insurers.

REAL ESTATE DEVELOPERS

Counseling Chicago-based and national developers by:

  • Managing critical path delays, change order requests, mechanics lien claims, and lender/title issues in real-time.
  • Completing distressed projects facing injunctions, bankruptcies, liens, cost overruns, and surety bond claims.
  • Prosecuting claims against architects, engineers, contractors, and design-builders to maximize recoveries. 
  • Defending against claims brought by condo associations and unit owners.

PROPERTY OWNERS

Advising institutional owners in:

  • Developing a $650 million healthcare project by providing daily counsel on issues from payments to surety bonds to TIF and M/WBE compliance; resolving nearly 80 mechanics liens; and handling the related mediations, arbitrations, and lawsuits. 
  • Federal court litigation on a billion-dollar project facing total claims in excess of $150 million involving delay, disruption, loss of efficiency, and substantial defects.
  • Defending a utility against $25 million delay, site conditions, and contractor fraud claims in a 3-week evidentiary AAA arbitration hearing.
  • Procurement and structuring of a $60 million transportation infrastructure project that was developed with state and federal funds.

CONTRACTORS

Experience helping builders:

  • Counseling a specialty contractor to manage critical defects that it elected to repair mid-project at a $34 million out-of-pocket cost.
  • Defending the builder of a 71-turbine, 109.5-megawatt wind farm facing a lawsuit constitutional challenge to its special use zoning approval.
  • Representing a GC who suffered a major fire on a project facing financing loss and foreclosure, subrogation, and insurance coverage lawsuits.
  • Representing a prominent design-builder in an AAA arbitration in claims related to the complex mechanical systems of an ice arena.
